Prosecution of Long-Term Disability Claims


J.B Randolph is at ease in meshing its strong health-care area with its employment law areas of expertise in representing clients in long-term disability (LTD) matters. The practitioners in this field must be fully conversant, as we are, with the medical and vocational aspects of a case, as well as the complex federal laws, especially the Employment Retirement Income Security Act (ERISA), that apply to this field. Any client facing denial of a claim for monthly disability benefits finds himself or herself in a nightmarish situation: the fact of being ill and unable to work, the frustration of having to go usually alone at first through a lengthy claim process, treating with physicians who are often not familiar and are easily manipulated by experienced insurance professionals, and ultimately receiving a verbose denial letter with the advise to seek an appeal and pursue litigation under ERISA. In our experience, the average client had had in mind that a simple application for benefits might suffice. It is then our role, once retained, to simplify the claim and litigation process for our clients so they can take care of themselves and await the outcome of the case. Although under applicable laws litigation tends to favor employers and insurance administrators in this field, much more often than not, our firm in successful in achieving recovery for our clients. The firm has participated in litigation in matters as small as five year of benefits remaining under a disability Plan to large private insurance (non-employment based) matters with potential pay-outs, individually, of millions of dollars.

COMPLEX LITIGATION
A significant portion of the practice of J.B Randolph is dedicated to complex litigation matter. These matters either fall in an area in which investigation or pre-litigation activities at the firm are extensive, claims processing is time-consuming and intricate, resources provided for a typical case must be vast and/or the case falls in an area of the law that lends itself to extended and protracted litigation. The firm considers its practices in the field of employment law, long-term disability law, contract dispute litigation and the related stock-option litigation sub-field to be its areas of complex litigation practice. J.B Randolph, over the years, has developed expertise that permits it to handle large-scale litigation of matters in these areas with much success. The firm has the ability to absorb and process huge volumes of materials and place them in formats that are always readily available to attorneys and staff at any given moment in the pre-litigation, litigation and post-litigation phases of the practice. The firm is at ease in litigation cases in State and Federal courts, at trial and appellate levels.
